1. About this policy
Terracette Group Pty Ltd and its related entities, including its development companies and project special purpose vehicles (together "Terracette", "we", "us" and "our"), respect your privacy.
This policy explains how we collect, hold, use and disclose personal information, and how you can access, correct or complain about the personal information we hold about you. We handle personal information in accordance with the Australian Privacy Principles (APPs) in the Privacy Act 1988 (Cth).
This policy applies to our websites, including terracette.com.au and any project website we operate, and to our dealings with buyers, prospective buyers, consultants, contractors, suppliers and other people we do business with. Where a project is run through a project company, that company is the entity collecting your information and this policy applies to it. If you want to know which entity holds your information, ask us and we will tell you.
2. What is personal information
Personal information is information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether the information is true or not and whether it is recorded in a material form or not.
3. The personal information we collect
We only collect personal information that is reasonably necessary for our functions and activities as a property developer and vendor. That information will usually include:

your name, email address, telephone number and postal address

the country you are enquiring from, which we use to identify enquiries that may involve foreign investment requirements

the content of any enquiry, message or correspondence you send us

your property requirements, preferences and feedback, including budget range, timing and the features you are looking for

records of your interactions with us, including inspections attended, appointments, calls and emails

where you buy from us or enter into a contract with us, information required to complete and administer that transaction, including identification, conveyancing and settlement details

if you are a consultant, contractor or supplier, your business contact details and information necessary to engage and pay you

technical information about your use of our websites, including your IP address, device and browser type, operating system, referring pages, the pages you view and the date and time of your visit
4. How we collect personal information
We collect personal information:

directly from you, when you complete an enquiry form on one of our websites, email or call us, register your interest in a project, attend an inspection or display, sign an attendance register, or provide us with documents

from the selling agent appointed to a project, who may pass on your enquiry and the details you have given them

from our consultants, contractors, suppliers and other business partners

automatically through cookies and analytics on our websites, as described in section 10

from publicly available sources and third party data providers, where relevant to a property transaction
5. Website enquiry forms and the selling agent
Enquiries submitted through our project websites are sent to Terracette and to the selling agent appointed to that project. For 11 Pickworth Avenue, Balgowlah, the appointed selling agent is Cunninghams Property (Cunninghams Real Estate). This is stated on the enquiry form itself.
Your enquiry will be recorded in the selling agent's customer relationship management system. Once it is, the agent holds that information as its own and handles it under its own privacy policy. If you want your details corrected or removed from the agent's records, or want to stop receiving the agent's marketing, please contact the agent directly. We will pass on a request if you ask us to, but we do not control the agent's systems.
If you would prefer to contact us without your details going to the selling agent, email us directly rather than using the enquiry form.
6. Why we collect, hold, use and disclose personal information
We collect, hold, use and disclose personal information to:

respond to your enquiry and provide you with information about a property or project

arrange and conduct inspections, appointments and buyer briefings

negotiate, document, complete and administer the sale of a property

keep you informed about the progress of a project you have registered interest in

7. Disclosure of personal information
We may disclose your personal information to:

the selling agent and its staff for the relevant project

our project partners, including architects, designers, builders, engineers, certifiers, marketing and communications agencies and photographers, where required for the project

our professional advisers, including lawyers, accountants, conveyancers, valuers and insurers

our financiers and investors, where relevant to a transaction

service providers who support our business, including website hosting, email, cloud storage, customer relationship management, analytics and mailing houses

purchasers or prospective purchasers of our business or assets

government agencies, courts, regulators and law enforcement, where required or authorised by law

any other person with your consent, or where disclosure is necessary to lessen or prevent a serious threat to the life, health or safety of any individual or to public health or safety
8. Direct marketing
We may use your contact details to send you information about our properties, projects and events, including by email, SMS and post.
Where we collected your details directly from you, we will do this only where you would reasonably expect it. Where we received your details from a selling agent or another third party, we will do this only with your consent, or where it is impracticable to obtain consent and we tell you how to opt out.
9. Cookies, analytics and third party websites
Our websites are built and hosted on third party platforms, including Wix, and use cookies and similar technologies. Cookies are small files placed on your device. We use them to:

keep the website functioning correctly and securely

understand how visitors use the site, including which pages are viewed and for how long, so we can improve it

measure the performance of our advertising
Most browsers allow you to refuse or delete cookies through your browser settings. If you disable cookies, some parts of our websites may not work as intended.
Our websites may contain links to other websites, including those of selling agents, project partners and social media platforms. We are not responsible for the privacy practices of those websites. We encourage you to read their privacy policies before providing personal information to them.
10. Overseas disclosure
Some of our service providers store or process data on servers located outside Australia. These currently include website and hosting providers with operations in Israel and the United States, and email, cloud storage and analytics providers with operations in the United States and in Europe, including Ireland and the Netherlands.
Where we disclose personal information to an overseas recipient, we take reasonable steps to ensure that the recipient handles it consistently with the Australian Privacy Principles. Under the Privacy Act we generally remain accountable for how an overseas recipient handles your information.
11. Data quality
We take reasonable steps to make sure the personal information we collect, use and disclose is accurate, up to date, complete and relevant. If your details change, or you think our records are wrong, please tell us using the details in section 16.
12. Storage and security
We hold personal information in electronic systems and, in some cases, in hard copy. We take reasonable steps to protect personal information from misuse, interference and loss, and from unauthorised access, modification or disclosure. These steps include access controls, authentication controls on our business systems, reputable cloud services and confidentiality obligations on our people and our service providers.
No method of transmission or storage over the internet is completely secure, and we cannot guarantee absolute security.
We take reasonable steps to destroy or de identify personal information when it is no longer needed for any purpose for which it may lawfully be used, unless we are required by law to retain it.
If we suspect a data breach, we will assess it within 30 days. If we form the view that a breach is likely to result in serious harm and we have not been able to prevent that harm, we will notify affected individuals and the Office of the Australian Information Commissioner in accordance with the Notifiable Data Breaches scheme.
13. Access and correction
You may ask us for access to the personal information we hold about you, and ask us to correct it if it is inaccurate, out of date, incomplete, irrelevant or misleading. Please make your request in writing using the details in section 16.
We will respond within a reasonable period and in any event within 30 days. We may ask you to verify your identity before we release or change information.
If we correct information we have previously disclosed to someone else, and you ask us to, we will take reasonable steps to notify that person, unless it is impracticable or unlawful to do so.
There are limited circumstances in which we may refuse access or correction, for example where giving access would have an unreasonable impact on the privacy of others, would prejudice legal proceedings or an investigation, or where the request is frivolous or vexatious. If we refuse, we will tell you why in writing and explain how you can complain. If we refuse to correct information, you may ask us to attach a statement to it noting that you consider it inaccurate, out of date, incomplete, irrelevant or misleading, and we will take reasonable steps to do so.
14. Complaints
If you believe we have breached the Australian Privacy Principles or mishandled your personal information, please contact us using the details in section 16. Please set out the details of your complaint so we can investigate.
